Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you do not have permission to access the Service.

Placing Orders for Pawhut® Products

The Service allows you to browse and purchase hamster cages, dog crates, rabbit hutches, cat trees and other products offered for sale by Pawhut® (collectively, “Pawhut Products“). When purchasing Pawhut Products on the Service, you agree to the following terms:

Product Descriptions: We strive to accurately describe our Pawhut Products, however we do not warrant that product descriptions or other content on the Service is accurate, complete, reliable, current, or error-free. Please contact us if you have any questions about a product.
Prices: All prices posted on the Service are subject to change without notice. Price increases will not affect any orders that you have already placed and for which payment has been received by Pawhut.
Payment Processing: All payments are processed by third party payment processors. You must abide by their applicable terms and conditions. We have no liability for unauthorized charges made using your payment method.
Order Confirmation: Your receipt of an order confirmation does not signify our acceptance of your order. Pawhut reserves the right to reject any order in its discretion.
Availability: We work to maintain accurate inventory on the Service but cannot guarantee availability. Pawhut may discontinue products at any time in its discretion.
Shipping and Delivery: When you purchase Pawhut Products, you agree to our shipping and delivery terms, which are incorporated here by reference.

Prohibited Activities

You may not access or use the Service for any purpose other than purchasing Pawhut Products for personal use. You may not use the Service for any illegal or unauthorized purpose. You agree not to, or facilitate any other person to:

Use the Service in any way that violates applicable federal, state, local or international law, these Terms, or any Pawhut policies.
Use the Service to engage in, promote or encourage illegal activity.
Impersonate any person or entity or provide false information to gain access to the Service.

Test vulnerabilities or attempt to gain unauthorized access to any system, data or information.
Circumvent or modify any security technology or software protecting the Service.
Interfere with or disrupt the Service, networks or servers connected to the Service.
Disassemble, reverse engineer or decompile any part of the Service.
Violate the privacy or infringe the rights of others.
Publish or share materials that are unlawful, inappropriate, profane, pornographic, obscene, indecent, libelous, threatening, abusive or promote hate.

Conduct any systematic retrieval of data or other content from the Service.
Attempt to gain unauthorized access to Pawhut’s computer systems.

Pawhut has the right but not the obligation to investigate your use of the Service and may restrict, suspend or terminate your access if it determines your use violates these Terms or applicable law.

User Accounts

When you create an account on the Service, you agree to maintain the security of your password and accept responsibility for any activities that occur under your account. You must immediately notify Pawhut of any unauthorized use of your account. Pawhut reserves the right to suspend or terminate accounts created with false or unauthorized information.

User Content

You retain any intellectual property rights you hold in content you submit, post or display on the Service (“User Content”). By posting User Content, you grant Pawhut a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such User Content in connection with our provision of the Service.

You are solely responsible for all User Content you make available. You represent and warrant that: (i) you own the User Content or have the right to grant us the license rights above; (ii) User Content does not violate the privacy rights, publicity rights, intellectual property rights or other rights of any person or applicable law; and (iii) we will not be required to pay fees or provide attribution to any third party.

We welcome feedback, comments and suggestions about how we can improve the Service (“Feedback”). Any Feedback you submit is considered non-confidential and non-proprietary. By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to use and publish the Feedback for any purpose without compensation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWHUT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PAWHUT MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT ACCESS TO THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR FREE OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

PAWHUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR DATA USE ARISING FROM YOUR USE OF THE SERVICE, WHETHER IN CONTRACT OR TORT, EVEN IF PAWHUT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PAWHUT’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE AMOUNT PAID BY YOU TO ACCESS AND USE THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify and hold Pawhut and its officers, directors, employees, agents and affiliates harmless from any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.

Governing Law and Jurisdiction

All matters relating to your access to or use of the Service shall be governed by the laws of England and Wales. Any legal action or proceeding relating to your access to or use of the Service shall be instituted in the courts located in London, England. You and Pawhut agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.

Changes and Amendments

We reserve the right to modify or amend the Terms from time to time in our discretion. Updated versions of the Terms will be posted on the Service with an updated effective date. Your continued use of the Service constitutes acceptance of any amended Terms. If an amendment is material, we will provide notice before the amendment takes effect.

General Terms

If any provision of these Terms is found unenforceable, it will not affect the enforceability of the remaining provisions. The failure of Pawhut to exercise or enforce any right or provision in these Terms does not constitute a waiver of such right or provision.

These Terms constitute the entire agreement between you and Pawhut relating to your access to and use of the Service.
